Notaries carry out their duties and authority, are obliged to guarantee the correctness of the deed, therefore Notaries are required to be honest, fair, and transparent in making deeds in order to guarantee all parties in the authentic deed they make. If the Notary is proven to have committed an unlawful act as stipulated in Article 1365 of the Civil Code, sanctions can be imposed in the form of replacing compensation. The formulation of the problem in this study is what are the legal consequences of the Cancellation of the Sale and Purchase Agreement by the Court and what is the legal responsibility of the parties related to the cancellation of the Sale and Purchase Agreement by the Court. The theories used in this study are the theory of legal consequences according to R Soeroso and the theory of legal responsibility according to Hans Kelsen. The method used in this study is a type of normative juridical research, namely literature law research or secondary data with primary, secondary and tertiary legal sources. The research approach used is a legislative approach, a case approach, and a conceptual approach, with the technique of collecting legal materials carried out by identifying and inventorying positive legal rules, book literature, journals and other sources of legal materials. For legal material analysis techniques, it is carried out by systematic interpretation and grammatical interpretation. The results of the research concluded that as a result of the law of cancellation of the Sale and Purchase Agreement made before the Notary, there is an element of unlawful act because one of the parties breaches the promise which causes the cancellation of the deed made by the Notary, namely the deed of the Sale and Purchase Agreement, the aggrieved party can take a lawsuit to the Court to cancel the deed made before the Notary, if it does not meet the subjective elements or null and void by law if it does not meet the objective elements as contained in Article 1320 of the Civil Code. The responsibility of the Notary in the event of an unlawful act in carrying out the duties of the position, there is a mistake committed by the Notary can be proven, then the Notary can be subject to sanctions in the form of compensation that has been determined by the Law in accordance with Article 1365 of the Civil Code.
