Abstract

Business developments in Indonesia has affected the developments of company groups, its growing rapidly in both private companies and state-owned companies. This research examines employment relations in the transfer of workers between companies that are members of a group companies from the perspective of labour law. There are no rules that explicitly regulate the procedures for transferring workers between companies in Indonesia. To implement employee transfers between companies, employers must pay attention to the rights of the transferred workers, for this reason it is necessary to do a research about employment relations in the transfer of workers between companies that are members of group companies to find out which parties are responsible for the rights of transferred workers. This research method uses normative juridical methods and legal certainty theory, which examines employment regulations as well as secondary legal materials such as legal journals and opinions of legal scholars. The results of this research are to find limitations for employers in the form of obligations that must be fulfilled to implement employee transfers between companies, so all parties can provide legal certainty about the workers rights. The conclusion of this research is no party should be disadvantage in the transfers of workers between companies.
